Flagrant Fouls Inc. ("Flagrant Fouls", "we" or "us") provides news, commentary, scouting, and fantasy advice throughout the world of basketball. We cover hoops at all levels, following players from when they first hit the national scene in grade 10 to the day they retire (hopefully) as multi-millionaires. We watch and evaluate players from the earliest point of their basketball development. We scout them in High School, follow them throughout the draft process as collegians, than then project their output on the professional level.

The online services offered by Flagrant Fouls include the "Flagrant Fouls Website" (which term includes www.flagrantfouls.com and any and all 'Flagrant Fouls' branded URLs) and all components thereof (including the Content, as defined below) and all other online services offered now or in the future by Flagrant Fouls (collectively, the "Services").
Doing business with Flagrant Fouls and using the Services involves providing information about yourself. We take your privacy very seriously and you have control over how your information is collected, used and disclosed by us. We also recognize that the growth of on-line services, including Internet services, has created additional privacy concerns, particularly for consumers. On-line privacy concerns focus primarily on the protection of “personally identifiable” information ("PII") which an individual or other customer reasonably expects to be kept private. As the term suggests, PII is information that, when associated with an individual identifies that individual, for example, a customer’s name, address, telephone number, e-mail address or credit card number.
Flagrant Fouls maintains strict privacy policies to safeguard Client Information and communications from unauthorized intrusions. The following is Flagrant Fouls' privacy policy (this "Privacy Policy"), which forms part of the Flagrant Fouls Terms of Use (the "Terms of Use Agreement") and is an integral part thereof.
Terms not otherwise defined in this Privacy Policy have the meanings ascribed to them in the Terms of Use Agreement.
What this Privacy Policy Covers
• This Privacy Policy covers Flagrant Fouls' treatment of the information we collect when you use the Services.
• This Privacy Policy applies to the Flagrant Fouls Website and all of the Services provided by us.
• This Privacy Policy does not apply to the practices of companies that we do not own or control, or to people that we doesdo not employ or manage, including without limitation, any of Flagrant Fouls' affiliates and business partners.
Information Collection and Use
• We collect PII when you create your Client Account, when you use certain of the Services, and when you enter promotions or sweepstakes. We may also receive PII from our business partners.
• Access to and use of certain of the Services requires that you create a Client Account. Upon registering for a Client Account, or through use certain of the Services, you are not anonymous to us. When you register for a Client Account we require certain information, including but not limited to your name, date of birth, postal code, email address and/or credit card information.
• We may collect PII from you should you choose to participate in activities such as sweepstakes, contests and surveys, because you want us to furnish you with certain services, newsletters or information.
• We automatically receive and record non-PII (i.e. information that does not identify you personally) on the Flagrant Fouls Website server logs from your browser including your IP address, cookie information and the page you requested. (User IP addresses are recorded for security and monitoring purposes.)
• We determine the purposes of collection, use and disclosure of the information you provide to us and, as such we are considered the data controller of such information.

Information Sharing and Disclosure by Flagrant Fouls
Cookies, Web Beacons and other Usage Data
• When you access the Internet, the computers that host web sites you visit (“web servers”) automatically receive some anonymous information. This “usage data” may include a record of which pages a web browser has visited. The Flagrant Fouls Website's server receives usage data when Users visit the Flagrant Fouls Website and when Users visit other sites as well. Flagrant Fouls and its advertisers and affiliates may use various kinds of software devices to collect information about Internet use.
• We may use cookies and similar tools to customize the content and advertising you receive based on the information you provide to us. The information used for this feature does not provide your PII or identify you as an individual to third parties, but will involve the processing of certain related data such as IP addresses.

o A pixel tag is a tiny image inserted in a webpage and used to record the number and types of views for that page. We may allow third party pixel tags to be present on the Flagrant Fouls Website for the purposes of advertising, providing services or data and statistics collection.
o We will not associate the information these software devices collect with your name, e-mail address or other PII.
• We also use "web beacons" to access our cookies inside and outside the Flagrant Fouls Website and in connection with the Services.
Advertising
• Advertising presented on the Flagrant Fouls Website may by delivered by Flagrant Fouls or one of our advertising partners.

o The advertising companies may also receive some anonymous information about advertisement viewing by Users on our web pages and other Internet sites. This information may be associated with a user’s web browser, but cannot be associated with a name or e-mail address without the user’s permission. o We do not supply PII to advertising companies or to individual advertisers or other third parties, and advertisers do not have access to our cookies.
o If you go to another web site, including an advertiser’s web site (for example by clicking on an advertisement), or request information or enter a contest, be aware that you may be authorizing another company, including an advertising company, to use information you supply. An advertiser's use of cookies is subject to its own privacy policies, not this one.
Links & Third Party Applications
• We may provide, and the Flagrant Fouls Website may contain, links to other websites. Although we strive to only link to websites that share our high standards and respect for privacy, we are not responsible for the content or practices employed by other sites.
• Third party applications (such as widgets) created by third party developers may also be available on the Flagrant Fouls Website. We do not control third party developers and cannot dictate their actions. When a you engage with a third party application, you are interacting with the third party developer, not with Flagrant Fouls. We strongly encourage you to not provide PII to any third party unless you know the third party with whom you are interacting.
• When you leave the Flagrant Fouls Website via a link, access a third party application or click on an advertisement, you should check the applicable privacy policy of the third party or advertiser to determine, among other things, how they will handle any information they collect from you.
Editing and Deleting Client Information and Accounts
• If you are a Client, you have the right to access, verify and update your Client Information at any time, including whether you want us to contact you about new services or other matters.
o You may modify or remove any of your PII (exclusive of your Username) at any time by logging into your Client Account and accessing the edit features.
o If you no longer wish to receive updates or notifications from us or one or more of our advertising partners, simply [access your Client Account and uncheck the appropriate box(es)].
o Upon such choice, we (i) will not contact you directly with such updates or notifications, and (ii) will not use PII obtained from your registration and/or Client Account or your use of the Flagrant Fouls Website or any of the Services to contact you with such updates or notifications.
• We honour requests from Clients to review all PII maintained in reasonably retrievable form, and will correct any such information which may be inaccurate. Clients may also verify that appropriate corrections have been made.
• You may request deletion of your Client Account at any time, for any reason, [by following the instructions on the Client Account page (You will be asked to verify your Username and password and confirm your choice to terminate your Client Account)]. PII and other information may remain in our archived records after your Client Account has been deleted for a period of [one (1) year], after which all of your PII will be deleted.
NOTE: NOT ALLOWING US TO USE CERTAIN INFORMATION MAY MEAN WE WON'T BE ABLE TO PROVIDE CERTAIN SERVICES WHICH MAY BE OF USE TO YOU.
Confidentiality and Security
• We have physical, electronic, and procedural safeguards to protect your PII and we use commercially reasonable measures to safeguard PII in Flagrant Fouls' possession against loss, theft and unauthorized use, disclosure or modification.
• In addition, we use reasonable methods to make sure that PII is accurate, up-to-date and appropriately complete.

Changes to this Privacy Policy
• We will keep this Privacy Policy current and as such may amend this Privacy Policy from time to time.
• We will inform you of any changes we make by sending a notice to the email address specified in your Client Account and/or by posting an announcement on the Flagrant Fouls Website.
